TERMS OF RENTAL
Dumpster Depot will provide dumpster disposal service using our roll-off containers. Service will be provided on the day requested when using our online ordering software. You must call 4 hours in advance to schedule a same day delivery, swap out or pick up and a $50 same day service delivery fee will apply to all new same day rentals. Additional days on your rental period will be $20.00 Per Day, until the roll-off is picked up.
Equipment Rental. (a) Customer certifies that he or she is either the property owner, has power of attorney for the property owner, or is the licensed contractor/broker for the property. Customer may not sublet the dumpster for any reason. (b) All equipment furnished by Dumpster Depot shall remain the property of the company, however “Customer” shall have care, custody, and control of the equipment and shall bear responsibility and liability for all loss, theft, or damage to the equipment and for its contents while at “Customer’s” location. “Customer” shall not move or alter the equipment and shall use the equipment only for its intended purpose. (c) Price. Customer agrees to rent a dumpster from Company according to the prices and fees set forth at the time of rental. The rental period begins the day/time the dumpster is dropped off, unless otherwise granted by Company. (c) Weight Limit. Customer agrees to restrict tonnage as specified below. If Customer exceeds the relevant tonnage limit, Customer hereby agrees to pay an additional fees outlined below per ton for each ton in excess of the limit for that dumpster. This price is prorated. Placement of Dumpster. Customer warrants and represents that any location provided by Customer for the dumpster is sufficient to bear the weight and size of the dumpster. Company shall not be responsible for any damage to pavement or any other road surface material, lawns, fences, shrubbery, septic system, private well, or any other form of property damage. Every effort will be made by the company to prevent property damage. Company has the right to refuse to place dumpster if they feel damage may occur. If the customer requires the dumpster to be moved after initial placement, a $150 dumpster relocation fee will be charged.
Dumpster Fill-Ups. Included in this dumpster rental is One (1) dumpster fill-up and One (1) dumpster trip to the Landfill to empty the dumpster of its contents. If you need more empty dumpsters, you will be charged again same the same price as your initial dumpster rental. Your dumpster rental does not include multiple trips to the landfill to empty the dumpster and does not include any additional fill-ups other than the first original fill-up. Our rental agreement permits only one filling of the dumpster.
Company Accessibility. Customer agrees to provide unobstructed access to the dumpster on the day it is to be picked up. Blocking or impeding retrieval of a roll-off on the agreed collection date will result in a dry run charge as specified below.
Content Regulations. (a) Customer is fully responsible for the entire contents of the container and is the rightful owner of the container’s contents until the container is dumped and the contents accepted by the prospective disposal facility. (b) Hazardous and Unacceptable Material Prohibited. Customer warrants and represents that the dumpster will not contain any hazardous materials and acknowledges that the disposal of such hazardous materials is strictly prohibited. For purposes of this Agreement, “hazardous materials shall mean any waste which is listed, has the characteristics of, or is otherwise identified as hazardous waste or subject waste under applicable state or federal laws or regulations, including but not limited to the Resource Conservation and Recovery Act of 1976 (42 U.S.C. et seq. and the regulations promulgated thereunder). “Unacceptable material” shall mean any non-hazardous waste which is not permitted to be processed at a facility under applicable laws or permits, source, special nuclear or byproduct material as defined by the Atomic Energy Act of 1954 and the regulations thereunder; asbestos-containing waste; mercury-containing waste; and any waste delivered by Customer which is not approved by Company. If Customer has any questions about whether a particular material is considered hazardous, please call the Company before disposing of the material in the dumpster.
Appliances. As per County waste management guidelines, depositing household appliances in our dumpsters is strictly prohibited as appliances are not allowed in the regular landfill and additional regulations are required for disposal. Appliances such as washers, dryers, stoves, refrigerators, dishwashers, microwaves, etc., are not permitted in regular dumpster loads. Any violation of this rule will result in an additional charge of $150.00. Prior approval is required for the disposal of appliances, as accommodations for their removal, upon approval, will be required at an additional cost.
Tires. As part of our dumpster rental policy and in compliance with County waste management regulations, depositing Rubber tires in our dumpsters is stricly prohibited as tires are not allowed in the regular landfill and additional regulations are required for disposal. Any instance of tires found in the dumpster load will incur an additional charge of $150.00. Prior approval is necessary for tire disposal, and we will make appropriate arrangements for their removal at an additional cost.
Concrete and roofing shingles. Heavy loads such as concrete and roofing shingles will be loaded only to the half fill line as marked on the interior of the dumpster. If you are unsure if your load is "heavy" please ask the Company.
Concrete Washout. Under no circumstances is washout allowed in the dumpster. In the event that the dumpster is used for wash out there will be a $300 cleaning fee applied to the rental.
Required for Pickup. Debris may NOT extend above the top rim of the dumpster. The tarp MUST be able to roll completely over the top WITHOUT OBSTRUCTION. The end doors MUST be CLOSED and secured before it can be removed. Overfilled or unprepared containers will be brought into compliance at Customer’s expense.
Consequences of Violating Regulations. In the event that contents that are not allowed by this contract or any Federal, State, Parish, or City agency are disposed of, all costs, fines, penalties, or other actions taken for said disposal, the customer is fully responsible for any and all associated charges. Costs may include but not be limited to cleanup, monitoring, legal fees, penalties, or any other charges associated with unauthorized material disposal. Materials may be returned to the customer at the customer’s expense.
Third-Party Interference. The customer is solely responsible for preventing any unauthorized use, tampering, or interference with the rented dumpster by third parties, including but not limited to neighbors, contractors, or passersby. Dumpster Depot shall not be held liable for any materials placed in the dumpster by parties other than the customer, and any additional costs or penalties incurred due to unauthorized use, including overloading, prohibited materials, or excess tonnage, will be the sole responsibility of the customer. The customer is encouraged to take necessary precautions, such as monitoring the dumpster or using locks or covers, to prevent unauthorized access. Failure to take appropriate precautions may result in additional fees, and the customer will be held responsible for any damages or violations caused by third-party interference. Dumpster Depot reserves the right to charge the customer for any issues arising from such interference, including removal of unauthorized materials or excess disposal costs.
Permits, Approval, and Fees. Customer shall be responsible for obtaining all necessary permits and approvals and paying all fees that may be incurred in conjunction therewith. This includes road/street permits for having dumpsters placed in the public roadway.
Indemnification. Customer agrees to indemnify and hold harmless the Company from, against and in respect to any and all claims, losses, expenses, damages, obligations and liabilities (including costs of collection and reasonable attorney’s fees) of any kind or nature whatsoever, including any misrepresentation, breach of warranty, or non-fulfillment of any representation, warranty, covenant or agreement of or by Dumpster Depot in this Agreement. This provision shall survive the termination of this Agreement.
Act(s) of God. In the event of any Act(s) of God, including but not limited to hurricanes, earthquakes, tornado's, floods, or other natural disasters and/or to also include national emergencies, martial law, fuel shortages or war which are beyond the control of the Dumpster Depot, Dumpster Depot shall not be held liable for any delays, damages, or inability to perform services as outlined in this agreement. Dumpster Depot shall not incur any liability for delays, damages or inability to pick up dumpsters as scheduled as a result of any Act(s) of God or other reasons listed herein. In the event our services are suspended as a result of an Act of God or reason outlined herein, customer agrees to take reasonable steps to mitigate any potential losses, and our services will resume as soon as it is safe and feasible to do so.
Entire Agreement. This Agreement contains the entire agreement between the Parties and supersedes all prior agreements and understanding, oral or written, between the Parties with respect to the subject matter hereof. No representation, inducement, promise, understanding, condition or warranty not set forth herein has been made or relied upon by either Party hereto.
Amendment. This Agreement may be modified only by an agreement in writing signed by the Parties hereto.
Governing Law. This Agreement shall be construed and enforced in accordance with the laws of the State of Florida, without regard to the conflicts of law rules of such state.
Severability. Customer agrees that each provision contained in this Agreement shall be treated as a separate and independent clause, and the unenforceability of any one clause shall in no way impair the enforceability of any of the other clauses herein. Moreover, if one or more of the provisions or parts thereof contained in this Agreement shall for any reason be held to be excessively broad as to scope, activity or subject so as to be unenforceable at all, such provision or parts or provisions shall be construed by the appropriate judicial body by limiting and reducing it or them, so as to be enforceable to the extent compatible with the then applicable law.
Signature Applicability. By signing this agreement, the undersigned agrees that their signature on this contract applies to all current, past, and future rental agreements with our company, whether or not they individually sign each contract. The signature provided herein serves as acknowledgement and acceptance of the terms and conditions of all dumpster rental agreements past, present and future, including those that may be executed without a specific signature. This agreement shall remain binding for all subsequent transactions unless explicitly revoked in writing. In the event of revocation, the customer's signature will still apply to all past and current rental agreements executed prior to the revocation.
Authority and Binding Signature of Representatives. Any representative or individual signing this agreement on behalf of the company or principal acknowledges and agrees that their signature binds the principal to the terms and conditions of this contract as if the principal had signed it personally. The principal shall be fully responsible for all obligations and liabilities under this agreement, regardless of whether they have directly signed the contract themselves, and the signature of any authorized representative will be treated as a full and binding commitment by the principal.
Waiver. A waiver of any claim, demand or right based on the breach of any provision of this Agreement shall not be construed as a waiver of any other claim, demand or right based on a subsequent breach of the same or any other provision.
Notice. Any notice required or permitted to be given under this Agreement shall be sufficient only if in writing and if sent by United States mail, certified, return receipt requested, postage prepaid, to the Parties at the addresses set forth in the first paragraph of this Agreement.
Additional Charges:
All customers are responsible for the total weight of the contents of their dumpster(s). All customers must call 4 hours in advance to schedule an extended dumpster pickup time or additional days otherwise ALL pickups are automatic irrespective of extent of dumpster use by customer. All customers are responsible for ensuring their dumpster(s) are not overloaded. Customers shall inspect the dumpster upon delivery for any existing damage. Upon removal of the dumpster, Dumpster Depot shall be entitled to charge the customer for the repair or replacement costs attributable to any damage to the dumpster while in the customer’s possession. The customer shall be liable for any repair or replacement costs. Upon removal, the customer authorizes Dumpster Depot to collect any additional disposal and repair or replacement costs attributable to the customer.
Exceeding stated weight allowance will result in an additional charge of $60.00 or $75.00 per ton as outlined below
7 yard - 2000lbs included ($60.00 per each additional tonnage) - max tonnage: In no event will customer load debris weighing 6,000 lbs or more
10 yard - 2000lbs included ($60.00 per each additional tonnage) - max tonnage: In no event will customer load debris weighing 7,000 lbs or more
15 yard - 3000lbs included ($60.00 per each additional tonnage) - max tonnage: In no event will customer load debris weighing 8,000 lbs or more
20 yard - 4000lbs included ($60.00 per each additional tonnage) - max tonnage: In no event will customer load debris weighing 8,000 lbs or more
30 yard - 5000lbs included ($75.00 per each additional tonnage) - max tonnage: In no event will customer load debris weighing 8,000 lbs or more
40 yard - 5000lbs included ($75.00 per each additional tonnage) - max tonnage: In no event will customer load debris weighing 8,000 lbs or more
EXCEEDING MAX TONNAGE: Any weight above the max tonnage will be charged to the customer in the amount of $200.00 per each tonnage over the max tonnage stated above per each dumpster. Additionally, Dumpster Depot may refuse to pick up any dumpster if at Dumpster Depot's discretion any dumpster has been overloaded and may require off-loading of some or all of the dumpster's contents which if required, shall be at customer's expense.
Blocking or impeding retrieval of a roll-off on the agreed collection date will result in a dry run charge.
A dry run charge is $150.00 per occurrence.
Cleaning due to loading of restricted or hazardous materials may be billed at a 3rd party rate plus a reasonable markup.
Damage Waiver Protection: 1. Coverage: The Damage Waiver Protection covers accidental damage to the rented items during the rental period. This includes damage caused by normal wear and tear, as well as minor accidental incidents. 2. Exclusions: The Damage Waiver Protection does not cover intentional damage, loss, theft, or damage caused by misuse, abuse, or negligence. 3. Reporting: Any damage to the rented items must be reported to us immediately. Failure to report damage may result in the waiver being voided and the customer being responsible for the full cost of repairs or replacement. 4. Limitations: The Damage Waiver Protection has a maximum coverage limit per rental item. Any damage exceeding this limit will be the responsibility of the customer. 5. Fees: A fee will be charged for the Damage Waiver Protection, which will be outlined at the time of rental. This fee is non-refundable and must be paid in full before the rental period begins. 6. Claims Process: In the event of damage, the customer must provide a detailed description of the incident and any relevant documentation, such as photos or witness statements. A claims adjuster will assess the damage and determine the appropriate course of action. 7. Terms and Conditions: By purchasing the Damage Waiver Protection, the customer agrees to abide by these terms and conditions. Any violation of these terms may result in the waiver being voided and the customer being held liable for all damages.
Dumpster tarp rental: 1. Rental Period: The rental period begins on the date the dumpster is delivered to the customer and ends on the date the dumpster is picked up by our team. The rental period is the length of your dumpster rental. 2. Payment: Payment for the dumpster tarp rental is due in full at the time of booking the dumpster. 3. Damage and Loss: The customer is responsible for any damage to the dumpster tarp during the rental period. This includes tears, rips, stains, or any other damage that may occur. In the event of loss or irreparable damage to the tarp, the customer will be responsible and charged 150.00 for the cost of replacement. 4. Use of the Tarp: The dumpster tarp is intended for use as a cover for dumpsters to prevent debris from escaping and to protect the contents from the elements. It should not be used for any other purpose, such as a shelter or as a ground cover. 5. Safety: The customer is responsible for ensuring that the dumpster tarp is used in a safe manner. This includes securing the tarp properly to the dumpster to prevent it from blowing away in strong winds or causing any hazards. 6. Cancellation Policy: Cancellations must be made at least 24 hours before the scheduled delivery date to receive a full refund. Cancellations made less than 24 hours before the delivery date may be subject to a cancellation fee. 7. Liability: Dumpster Depot is not liable for any damages or injuries that may occur as a result of the use of the dumpster tarp. The customer assumes all risks associated with the rental and use of the tarp.
4-hr Delivery Guarantee: In the event that you place an order for a dumpster with our company and request 4-hr delivery, we guarantee that the dumpster will be delivered to your specified location within 4 hours of order confirmation.

The 4-hour delivery guarantee begins upon the confirmation of your order by our customer service representative.
This guarantee applies to standard-sized dumpsters and is subject to availability.
Any orders placed outside of regular business hours will be processed and include a emergency delivery surcharge.
The guarantee is valid for local delivery addresses within our regular service area.
Delays caused by circumstances beyond our control, such as traffic, weather conditions, or force majeure events, may exempt us from the guarantee.
Claiming the Guarantee: If the dumpster is not delivered within the guaranteed timeframe, please contact our customer service immediately at 863.330.0133. We will promptly investigate the matter and take corrective action, which may include a refund or discount on your order at the discretion of Dumpster Depot.

Terms and Conditions:

This surcharge is non-refundable, even in the event of a delivery delay due to circumstances beyond our control, such as traffic or weather conditions.
Waste Material
“Customer” agrees not to put any hazardous or toxic waste in the dumpster as it is against the law. Customer agrees not to put any waste that is liquid, or any waste that is, or contains, radioactive, volatile, corrosive, highly flammable, explosive, biomedical, biohazardous, infectious, toxic, and/or any hazardous wastes or substances (“Prohibited Waste”) into roll-off containers. Prohibited Waste includes, but is not limited to, industrial waste, waste containing asbestos, septic tanks and waste, paint, cleaning solutions, biomedical waste, animal carcasses, pesticides, solvents, automobiles, automobile parts, tires, oil, oil filters, oil containers, gas cans, propane tanks, batteries of any kind, appliances with Freon (air conditioners, refrigerators, etc.), Freon aerosol cans, foam aerosol cans, electronics (TV’s, computers, monitors, computer parts, radios, etc), hazardous waste (ballasts with PCB’s devices containing mercury, fluorescent bulbs, etc.) telephone poles, railroad ties, or radioactive materials.
Inspection/Rejection of Prohibited Waste
Title to and liability for Prohibited Waste shall remain with Customer at all times. Dumpster Depot shall have the right to inspect, analyze, and/or test any waste delivered by customer. When it comes to prohibited waste, a thorough inspection is conducted to ensure compliance with disposal regulations. If any items deemed as prohibited waste are identified during this inspection, they will be rejected, and proper measures will be taken to handle and dispose of them in accordance with environmental guidelines. This process aims to maintain a safe and responsible waste disposal environment.
Acknowledgement
Customer acknowledges that Dumpster Depot shall not be liable for any damage to driving surfaces resulting from Dumpster Depot trucks placing containers on the agreed upon areas and the surroundings. Customer acknowledges that they are not allowed to move around any roll-offs with their personal equipment or a third party’s equipment.
Card on File - Subsequent Charges
At Dumpster Depot, we are dedicated to delivering a smooth and convenient customer experience. To promptly address any unforeseen incidents like damage, overloading, unauthorized disposal, or exceeding the agreed tonnage, we securely keep our customers' card information on file until all account charges are settled and paid. By accepting our terms and conditions, the customer acknowledges, authorizes and consents to Dumpster Depot making a secondary charge on their card to settle any potential additional fees that may arise throughout the rental period. Any such charge will be after the dumpster has been picked up and emptied of its contents to ensure the accuracy of any final rental charges. Dumpster Depot will always provide a statement of charges to customers regarding any additional charges. This approach enables us to handle issues efficiently, ensuring our customers enjoy a rental experience that is stress-free and worry-free as well as allowing us to close out all rental contracts.
Payment Terms
Prepayment at the time of reservation of initial rental fees is required by debit card or credit card, Dumpster Depot will keep that card on file until the account is at a zero balance.
